Master Terms of Service
These Master Terms of Service govern your use of the LinkXG
platform and related services provided by Striped Hare Ltd.
1. Definitions
Platform means the LinkXG web application and
related services.
Contributor means a Customer who uploads or
shares Product Data through the Platform.
Consumer means a Customer who accesses Product
Data shared by Contributors.
Product Data means data relating to products,
materials, components or services uploaded to or processed
through the Platform.
2. Disclaimers
The Platform is provided "as is" without warranties of any kind,
whether express, implied or statutory. LinkXG does not warrant
that Product Data is accurate, complete, current or fit for any
particular purpose.
Nothing on the Platform constitutes certification, assurance,
audit opinion or endorsement by LinkXG of any Product Data,
supplier, product, claim or representation.
LinkXG does not provide legal, regulatory or compliance advice.
Use of the Platform does not guarantee compliance with any law,
regulation or standard.
3. Data Ownership and Intellectual Property
Contributors retain ownership of Product Data they upload to the
Platform. By uploading Product Data, Contributors grant LinkXG a
limited licence to host, process, display and transmit that data
as necessary to operate the Platform.
Access to Product Data does not transfer ownership or confer any
licence beyond the limited right to use the data for internal
business purposes.
4. Availability and Support
LinkXG will use commercially reasonable efforts to make the
Platform available in accordance with its standard operating
practices. The Platform is provided on an as-available basis and
may be subject to planned maintenance, updates or unplanned
interruptions.
Support services, if any, are provided in accordance with the
applicable Subscription Plan.
5. Limitation of Liability
To the fullest extent permitted by law, LinkXG's total liability
arising out of or in connection with this Agreement shall not
exceed the fees paid by the Customer in the twelve months
preceding the claim.
LinkXG shall not be liable for any indirect, incidental, special,
consequential or punitive damages.
6. Governing Law
This Agreement shall be governed by and construed in accordance
with the laws of Scotland. The courts of Scotland shall have
exclusive jurisdiction.
Privacy Notice
This Privacy Notice explains how LinkXG collects and uses
personal data when individuals interact with our websites,
platform and services.
LinkXG is a business-to-business platform. Most data processed on
the platform relates to organisations and products rather than
individuals.
Who We Are
LinkXG is operated by Striped Hare Ltd, a company registered in
Scotland (company number SC869047).
For the purposes of data protection law, Striped Hare Ltd acts as
a data controller for personal data relating to account
administration, billing, marketing and website use, and as a
data processor for personal data included within
customer-controlled data uploaded to the platform.
Personal Data We Collect
We collect and process the following categories of personal data
where relevant:

Account and user information, including name, business email
address, role and organisation

IP addresses and audit logs

Billing and subscription data, including contact details
associated with invoices and payments

Individuals have rights under applicable data protection laws,
including rights of access, rectification, erasure, restriction,
objection and data portability.

Acceptable Use Policy
This document defines the acceptable use, rights and conduct
obligations for customers using the LinkXG platform. It is
designed to provide clear, enforceable guardrails suitable for
MVP launch, while supporting LinkXG's role as a trusted
multi-party data network.
General Acceptable Use
Customers must use the Platform in a lawful manner and in
accordance with this Agreement, all applicable Subscription
Plans, and any usage guidelines published by LinkXG from time to
time.
Customers must ensure that their Authorised Users are aware of
and comply with the obligations set out in this Agreement.
Prohibited Activities
Customers must not, and must not permit any Authorised User or
third party to:

Upload Product Data without having the necessary rights and
authority to do so

Upload false, misleading, fraudulent or materially incomplete
information

Interfere with, disrupt or attempt to gain unauthorised access
to the Platform

Scrape, harvest or bulk extract data outside permitted
interfaces or APIs
-
Use the Platform to develop, train or enhance competing
products or services
-
Misrepresent their identity, role or authority within a supply
chain
-
Circumvent agreed commercial arrangements or Subscription Plan
limits
Network Conduct and Trust Principles
Customers acknowledge that LinkXG operates as a shared business
network and agree to act in good faith towards other network
participants.

Do not use Product Data to deliberately bypass or
disintermediate existing suppliers
-
Do not pressure Contributors to disclose data beyond what is
reasonably required

Do not use access to gain unfair competitive advantage through
misuse of Product Data
Monitoring and Enforcement
LinkXG may monitor use of the Platform to ensure compliance with
this Agreement, applicable laws and network integrity
requirements.
LinkXG may suspend or restrict access to the Platform if it
reasonably believes that a Customer has breached this Agreement
or poses a security, legal or reputational risk.
Data Processing Agreement
This Data Processing Agreement ("DPA") supplements the Master
Terms of Service and sets out the terms on which LinkXG
processes Personal Data on behalf of Customers.
Definitions and Roles
Controller means the Customer.
Processor means LinkXG.
LinkXG acts solely as a Processor when processing Personal Data
on behalf of the Customer. The Customer acts as Controller.
Scope of Processing
LinkXG processes Personal Data solely for the purpose of
providing the Platform and related services as described in the
Agreement.
Processing activities include storage, organisation, retrieval,
consultation, disclosure by transmission, and erasure of Personal
Data as necessary to operate the Platform.
Customer Responsibilities
The Customer is responsible for ensuring that it has a lawful
basis for uploading Personal Data to the Platform.
The Customer shall provide documented instructions to LinkXG
regarding the processing of Personal Data.
Security Measures
LinkXG shall implement appropriate technical and organisational
measures to protect Personal Data against unauthorised access,
loss, destruction or damage, taking into account the state of the
art, the costs of implementation, and the nature, scope, context
and purposes of processing.
Sub-processors
LinkXG may engage sub-processors to assist in providing the
Platform. A current list of sub-processors is available upon
request. LinkXG will notify Customers of changes to
sub-processors.
Data Subject Rights
LinkXG shall assist the Customer in responding to requests from
data subjects exercising their rights under applicable data
protection laws, to the extent technically feasible and required
by law.
Deletion and Return
Upon termination or expiry of the Agreement, LinkXG shall delete
or return Personal Data in accordance with the Agreement, subject
to applicable legal retention requirements and technical
limitations.

technologies on its websites and platform.
